DSK Legal Competition Law Newsletter – February 2024

Welcome to the DSK Legal Competition Law Newsletter February 2024 edition. February saw the Competition Commission pass its 25th order dismissing a complaint at the threshold since the new Chairperson took office in May 2023. In the same period one proceeding was closed contrary to the recommendation of the investigation report, and while two orders were passed under Section 27 finding a contravention, no monetary penalty was levied in either case. There have been no published orders initiating a fresh investigation into anti-competitive practices or abuse of dominance. These stats stand out amongst recent reports of MCA’s review of CCI’s perceived inaction (see https://www.thehindubusinessline.com/economy/fm-to-review-cci-performance-amidst-rising-concerns-of-regulatory-inaction/article67828126.ece and https://www.taxscan.in/mca-to-review-ccis-performance-amid-app-developers-allegations-against-google/373538/).
