DSK Legal Competition Law Newsletter – April 2024

The last quarter saw several statutory updates on the competition law front. The Ministry of Corporate Affairs released the much awaited Report on Digital Competition Law, with an intention to rein in big tech along the lines of the DMA in the EU. It also released draft Rules relating to the Green Channel mechanism, target De Minimis thresholds, and Exemptions to notifying certain transactions.

We bring to you all the updates, four of the most relevant combination orders, and the first (public) prima facie order initiating an investigation passed by the Commission in the last two years:

  1. CCI initiates yet another probe into Google but rejects interim relief;
  2. CCI approves acquisition of Wistron Infocomm Manufacturing by Tata Electronics;
  3. CCI approves acquisition of stake in MG Motor India by JSW Ventures;
  4. CCI approves investments in API Holdings by Goldman Sachs, CDPQ, and Naspers; and
  5. CCI approves acquisition of stake in Religare Enterprises by the Burman Family.

Regulatory Updates on:

  1. Digital Competition Law;
  2. Draft Competition Commission of India (Exempted Combinations) Rules, 2024;
  3. Draft Competition Commission of India (De Minimis) Rules, 2024; and
  4. Draft Competition Commission of India (Green Channel) Rules, 2024

We hope this is helpful. Please feel free to revert in case of any clarifications.
