About Prashant Pakhiddey

Prashant has handled litigation matters before the Supreme Court/ Various High Courts in India/ Commissions/ Tribunals and District Courts. He has in-depth knowledge of various fields of law and his experience extends to all aspects of litigation/ arbitration and commercial matters.

Prashant has represented clients in various high profile commercial/ corporate disputes as well as criminal matters. He has advised clients on execution of contracts/ negotiations, regulatory compliances (environmental regulations, packaging/ labeling requirements for FMCG sector as well as seed industry), stamp duty aspects, MRTP/ competition issues, real estate, Constitutional issues, pricing issues, etc.

Prashant became a Partner (Litigation) in April 2008. Since then, he has led teams in various high-profile litigation matters before various High Courts in India as well as the Supreme Court. Since 2008, he has experience of handling civil / commercial & criminal litigations, including enforcement / challenges to arbitration awards (domestic & foreign awards), challenges to State Acts, petitions related to Biological Diversity / Insecticides Act, SEBI Regulations (Credit Rating Agencies), claims of farmer’s compensation, etc.

Key Experience:

  • Currently advising GMR in respect of its challenge to an award (INR 1000 crores) passed in an International Commercial Arbitration.
  • Currently advising GMR in respect of its contractual disputes arising in respect of the Bajoli Holi hydro power project. (Claim amount INR 400 crores approx.)
  • Advised Monsanto in respect of its disputes with sub licensees. Issue involved was payment of royalty fee / sub license fee for use of Bt. Technology. There were 10 separate arbitrations involving INR 450 crores.
  • Advised Monsanto in respect of (a) litigations pertaining to introduction of agriculture biotechnology in India (Supreme Court and various other High Courts); (b) litigations challenging regulation of price of Bt. Technology (before Supreme Court / various High Courts); (c) criminal prosecutions arising under the Insecticides Act; (d) seed & chemical products packaging & labeling; (e) litigations pertaining to compensation claims by farmers under State seed enactments.
  • Advised National Seed Association of India (NSAI) in respect of its Constitutional challenge to seed law enacted in the State of Gujarat / Maharashtra / Andhra Pradesh. Act enacted by State of Gujarat was set aside.
  • Advised Maharashtra Hybrid Seeds Company Ltd. (Mahyco) in respect of: (a) entire portfolio of seed for review of packaging / labeling requirements; (b) various litigations on seeds / price control in Maharashtra / Andhra Pradesh / Madhya Pradesh; (c) quashing petitions arising out of criminal prosecutions under seed laws / Biological Diversity Act; (d) issues / advice under the Biological Diversity Act / Seed laws / Protection of Plant Variety and Farmers Rights Act; etc.
  • Advised SI Group in respect of actions initiated by the Pollution Control Boards under the Environment Protection Act;
  • Advising GR Infra-projects Ltd. in respect of various challenges to arbitration awards (by other party & by GR Infra) before various Courts (Delhi High Court / Commercial Courts at Jaipur).
  • Advised Xstrata Coal Queensland PTY Ltd. in respect of enforcement of various foreign awards before Courts at Delhi / Maharashtra / Orissa.
  • Advising ICRA Ltd. (credit rating agency) in various litigations pertaining to rating provided to various entities (High Court of Delhi / Bombay / Madras / Telangana / Securities Appellate Tribunal). Also advising ICRA in respect of SFIO investigations connected to ILFS and DHFL matters.
