Experience

Kanika Chaudhary Nayar has over 15 years of experience and has been working in the competition law space since the inception of competition law in India. She received her master’s degree in 2009 from the prestigious Kings College London with merit in International Commercial Laws along with EC Competition Law.
She regularly appears before the CCI, NCLAT, High Courts and the Supreme Court representing clients in a variety of matters including cartel investigations, abuse of dominance cases, as well as matters relating to anti-competitive agreements. She also advises and handles merger control filings before the CCI. She has also assisted the CCI during framing of regulations.
She deals with intricate and complex competition issues for her clients and assists in rendering strategic solutions pertaining to Indian competition law. She has represented several clients in leniency proceedings before the CCI.
Kanika has also been actively involved in developing competition compliance/ training programmes for various multinational and Indian corporations and has specific experience in preparing clients for ‘dawn raids’.
She has been an Associate Editor for the Manupatra Competition Law Reports and has various publications to her credit in leading Indian and international journals, and business newspapers.

Recent Key Assignments

  • Kanika has represented Bayer, a German pharmaceutical company, in its acquisition of Monsanto, a US agrochemicals company. This deal was third in line to seek the CCI’s approval due to major consolidation in this space and underwent major scrutiny by the CCI. The merger was the largest overseas deal ever by a German company.
  • Kanika represents DHL in its ongoing cartelization case pending before the CCI. This is the first such case in the courier and logistics space.
  • Kanika represented JCB before the CCI, High Court and the Supreme Court in a matter filed by Bull Machines. The initial investigation order was quashed by the Delhi High Court.
  • Kanika represents GMR in its abuse of dominance case filed by one of the third-party service providers at the airport.
  • Kanika represented ICICI Ventures along with other investors in its acquisition of Wonder Products before the CCI and secured an approval.
