Experience

Ashish has extensive experience in WTO Dispute Settlement proceedings wherein he represented the Government of India as the lead counsel before a WTO Panel in its first Compliance proceedings under Article 21.5 of the DSU as well as India’s first and only Arbitration proceedings under Article 22.6 of the DSU. He was also India’s lead counsel in the appeal before the WTO Appellate Body in WT/DS430.

Additionally, he has also extensively advised various government departments in India as well as foreign governments and private organizations on issues concerning WTO covered agreements, Foreign Trade Policy, Rules of origin, Free Trade Agreements, Export control & sanctions, Customs issues and litigation, issues concerning FSSAI and BIS standards etc.

Ashish also regularly represents clients in trade remedial investigations such as anti-dumping duty; countervailing duty and safeguard duty investigations before the DGTR (formerly DGAD) as well as before the appellate forums such as the Hon’ble Supreme Court of India; High Courts and the Hon’ble CESTAT. He has also represented Indian exporters in trade remedial investigations initiated by other jurisdictions including the US ITC and the European Commission and has also advised the Government of India on countervailing duty investigations initiated by other countries against India.

Ashish has also frequently published articles on WTO and Customs issues and is a recommended lawyer in India for International Trade by respected publications such as Chambers and Partner and Legal 500 since 2017.

Recent Key Assignments

  • Represented the Government of India in WTO dispute India-Agricultural Products (DS/430) as a lead counsel. The representation covered all aspects of WTO dispute system including Article 21.5 proceeding and Article 22.6 proceedings as well.
  • Advised Government of India on certain legal issues arising under Public International Law. The legal advice was primarily focused on structuring International agreements/organisation’s in a manner which is consistent with the customary principles of International law, India’s commitment under International treaties as well as India’s domestic law.
  • Have advised clients on a broad spectrum of Customs, Export control issues, Foreign Trade Policy, FTA issues. This includes including replying to SCN’s, representing clients in proceedings before the Customs department and subsequent appeals and writ proceedings before the High Court.
  • Represented domestic manufacturers of PU Leather before the DGTR in an anti-dumping investigation concerning import of PU Leather from China PR. The representation resulted in imposition of anti-dumping duties on import of PU Leather into India from China PR.
  • Have advised clients on range of Regulatory laws such as BIS standards, filing representations before the BIS authorities, QCO’s etc, FSSAI issues, issues under Drugs & Cosmetics Act, issues concerning International Commercial Agreements and issues arising under Legal Metrology Act.
